Terms of Service

1. Acceptance & eligibility
By using Sunny Seed, you agree to these Terms of Service. If you do not agree, please do not use the app. You must be at least 18 years old and able to form a binding contract.
2. Service description & medical disclaimer
Sunny Seed is a baby development diary with tracking tools, WHO-based growth charts, and an AI assistant. It is not a medical device and provides no medical diagnosis or treatment. AI output and reference content are informational only and may be inaccurate — always consult your pediatrician for medical decisions. In an emergency, contact your local emergency services.
3. Account
You are responsible for the security of your account; use a strong password and do not share your credentials. You may invite others to your child's profile with limited permissions (editor or view-only) and are responsible for who you invite.
4. Subscriptions & auto-renewal
Sunny Seed offers a free plan and Premium subscriptions (monthly and annual), with a 7-day free trial for new Premium users. Subscriptions and payments are managed by the App Store (iOS) or Google Play (Android): payment is charged to your Apple ID / Google account on confirmation of purchase; the subscription renews automatically for the same period and price unless you turn off auto-renewal at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends. Current prices and periods are shown in the app before purchase. Any unused portion of a free trial is forfeited when you purchase a subscription. Manage or cancel your subscription in your App Store / Google Play account settings.
5. Cancellation, refunds & withdrawal
You may cancel at any time in your App Store or Google Play account settings; cancellation takes effect at the end of the current billing period. Refunds are handled by Apple or Google under their policies. For EU/EEA consumers: digital services begin immediately upon your request and consent, and you acknowledge that this may cause the loss of the 14-day right of withdrawal for content already delivered; your statutory consumer rights remain unaffected.
6. Acceptable use
You agree not to: use the service for illegal purposes; attempt to reverse-engineer or disrupt the app; upload content that is unlawful or infringes third-party rights; or misuse the AI assistant with harmful, abusive, or automated requests.
7. Your content & license
Your diary entries, photos, and other content remain yours. You grant Sunny Seed a limited license to host, process, and display your content solely to operate and provide the service to you (and to partners you invite). You are responsible for having the rights to the content you upload.
8. Intellectual property
Sunny Seed, its software, design, brand, and mascot are owned by Roman Koropets and protected by law. These Terms grant you a personal, non-transferable, revocable license to use the app; they do not transfer any ownership to you.
9. Limitation of liability
To the extent permitted by law, Sunny Seed is provided 'as is' and we are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be limited by law (including for gross negligence, intent, or death/personal injury). The AI assistant does not replace professional medical advice, and we are not liable for decisions made based on AI output.
10. Consumer rights
If you are a consumer, your mandatory statutory rights (including EU/EEA consumer protection and warranty rights) are not affected by these Terms. The EU Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.
11. Changes to terms
We may update these Terms. We will notify you of material changes by email or in-app notification at least 30 days before they take effect; continued use after that date means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of Georgia, without prejudice to the mandatory consumer-protection laws of your own country of residence. EU/EEA consumers retain access to the courts of their place of residence.
